Kelly + Kelly Lawyers is retained on a contingency fee basis in most cases of accidents and injuries, disability claims and insurance claims. This means that there is no fee for the initial consultation, no retainer payment is required, and no fee is payable until money is recovered for the client. The fee is calculated as a percentage of the money recovered. In addition to fees, and HST on those fees, disbursements are generally incurred. This means that Kelly + Kelly spends money on various items like investigators reports, medical records, assessments and reports, engineering opinions, etc. This money is spent to advance the client’s case, and will form part of the account to the client at the end of the case.

We comply with the Law Society’s rules for contingency fee agreements. Our contingency fees range from 15%-33% depending on the complexity and risk entailed in successfully prosecuting your case. Ultimately, our goal is to ensure that our fees are fair.

Employment Disputes

Legal services in respect to employment disputes are generally billed on an hourly basis, though a contingency fee agreement (as described above) may be allowed in certain cases.

The initial consultation in respect to an employment dispute is crucial and generally involves advice and guidance that is instrumental in the course and progress of the matter. Accordingly, initial consultations are not free of charge and are subject to an hourly fee. A retainer payment may be required, depending on the circumstances of the case.

Determination of whether a retainer fee may be required or whether a contingency fee agreement may be available and details on-going legal expenses are determined by the circumstances of the particular case, and are available after the initial consultation.

Family Law

Legal services for advice and representation in respect to domestic contracts, marriage breakdown, property equalization, spousal and child support, custody and access, and other matrimonial disputes and claims are generally billed on an hourly basis. In exceptional cases involving family property issues, a deferred payment agreement may be considered.

The initial consultation in these matters is crucial and generally involves advice and guidance that is instrumental in the course and progress of the matter. Accordingly, initial consultations are not free of charge and are subject to an hourly fee. In addition to fees, and HST on fees, disbursements are generally incurred. This means that money must be paid to the Court, to assessors, to appraisers, and others, in order to advance the client’s case.

Kelly + Kelly Lawyers requires a retainer payment for all family law services. Accounts are issued periodically, and the retainer payment must periodically be replenished in order to cover on-going fees and disbursements.
